Errors and Omissions claims against retail travel agencies generally reflect a high frequency/low severity loss profile, though it is not uncommon for seemingly small oversights to develop into more serious problems. For example, if a client claims that an agent failed to advise a business traveler of visa requirements and is prevented from closing a business contract, the agency involved could face a substantial lawsuit.
Also, inexperienced travelers may not recognize the difference between various classes of transportation and accommodations; i.e., deluxe, first class, and economy. To compound the problem, a standardized grading system does not exist on a worldwide basis.
It is not uncommon to see reputable hotels in some areas with common toilet facilities and rooms without air conditioning. This area of misunderstanding and non-standardization can give rise to legal action against the travel agent and can become quite costly, especially when group travel is involved.
However, the most potentially catastrophic claims against retailers involve injuries sustained by clients while traveling. Although the liability in such instances is generally contingent in nature, a lawsuit alleging that the agency was negligent in its selection of the particular motorcoach operator, transfer service, airline, cruise line, or other more "directly responsible" supplier can have serious ramifications. It may be claimed that, as a professional, the agent that booked the travel services should have warned the client about the supplier's lack of proper insurance, or accident history, etc.
Or if a traveler contracts ptomaine poisoning in a hotel in an area of the world where our citizens cannot seek litigation, a situation of potential liability could arise. Of course, the claimant's attorney will contend that a professional travel agent should have been aware of the refrigeration conditions, former food poisoning incidents, etc.
